Texas Governor Calls For This to Stop Barack Obama

Texas Governor Greg Abbott has led the charge in court against President Obama’s amnesty program for illegal aliens. Now he’s joining the fight to stop Obama’s leftist policies on another legal front.

Here’s the report from the Conservative Tribune:

“[Governor Abbott] is pushing a ‘convention of the states’ proposal that’s gained momentum in Obama’s second term as many conservatives attempt to rein in the federal government.

“The proposal aims to invoke Article V of the U.S. Constitution to propose new amendments to the founding document.

“… Abbott officially called for just such a convention to seize power from a federal government that is out of control and return it to the states. He called his proposed amendments ‘The Texas Plan.'”

Some of the amendments in the proposal include prohibiting administrative agencies and the unelected bureaucrats from creating and preempting federal law; mandating that Congress balance its budget; allowing a two-thirds majority of the states to override a U.S. Supreme Court decision, federal law or regulation; and prohibiting Congress from regulating activity that occurs within one state’s borders.

Abbott argued that Obama has abused his presidential authority, and trampled on the United States Constitution.


“If this is allowed, the United States Constitution has been completely rewritten. The United States Supreme Court is a co-conspirator in tearing down our Constitution, which is exactly why I am calling for a Convention of States so we can restore the Constitution to its original principles.”

The Texas governor also argues that a convention would force the federal government to “take the Constitution seriously again.”

We applaud Governor Greg Abbott for his courage in standing up to an ever-increasingly tyrannical federal government.

  1. I fully agree with Gov. abbott and hope that Article V comes to bear in the face of the federal government, once and for all, and to make absolutely certain that NO politician ever becomes exempt, by their own rule, of the very laws the swore an oath to uphold again.
    Right now, our government, supposed to be Elected Representatives, do NOT listen to We, The People and haven’t for many years.
    In addition, our states, in the view of the federal government, are not Sovereign which is why the feds think they can waltz in any time they so desire and impose federal law upon whoever they choose in our states.
    This needs to Stop Immediately!!

  2. There is a controversy going on now about ex-felons having the right to vote reinstated. BUT, how can a state give something back they could not remove in the first place.

    It is a well established that the constitution recognizes the citizens protection of “Rights” (enumerated and God given) from government infringement. That being the case how then can this same government pass a law that removes those rights without first changing the Constitution? After fulfilling the “written” court ordered payment for a crime that does not and cannot remove your citizenship, how does the government legally continue to impose restrictions? Have you noticed that they only try to enforce those restrictions that could affect their positions in government? One affect by vote and one by a gun seem to be the only ones they fear. They do not even try to enforce removing the first Amendment the fifth etc. If the Constitution said any conviction removes all citizenship granted by the congress I would not have any problem. However, Congress cannot grant “natural born citizen” status it would seem reasonable that they cannot remove the rights of a natural born citizen. If so then: “Congress could rationally conclude that any felony conviction, even an allegedly invalid one, is a sufficient basis on which to prohibit any person from being a citizen natural born or not.” Thus all citizens become subjects not citizens.

    Here is what the framers thought… When the Framers made the judiciary a separate branch of government, they did not intend to elevate judge-made rules to a level of equality with positive law, much less to a superior position, and yet that is how the Due Process Clause is now being interpreted with respect to the most fundamental and important issues in American society and family life. By gradually replacing the meaning of the Due Process Clause, the judiciary is exercising judicial review of the Constitution itself, for conformity with the judiciary’s own subjectivistic concept of inalienable rights and liberties.

    The U.S. Constitution reflects the will of the people, as that will is expressed in the words of the document itself, and those words are meant to withstand the changing temper of the judiciary. The great principle of liberty – in both the Fifth and Fourteenth Amendments – is inextricably connected to the principle of due process, and no court has authority to sever that connection. A wise New Yorker, and primary sponsor of the Due Process Clause, warned against such encroachments upon political liberty:

    [T]he people should make the laws by which they were to be governed. He who is controlled by another is a slave; and that government which is directed by the will of any one, or a few, or any number less than is the will of the community, is a government for slaves. The Due Process Clause requires that judicial proceedings unfold according to the law, rather than according to the judiciary’s contrary opinions.

        ((Note that the word due has much more meaning than suspected (go here http://www.andrewhyman.com/due.html )to find the implications)) This admendment also has a dual meaning; In that it also defferentiates natural born or naturalized meaning the two are different. As a point of fact pertaining to the 14th a Supreme court case (Afroyim v. Rusk, 387 U.S. 253 (1967) set the following…

        The basic point of the Supreme Court’s ruling in Afroyim v. Rusk was that the “citizenship clause” of the 14th Amendment to the US Constitution — while originally intended mainly to guarantee citizenship to freed Negro slaves and their descendants, and subsequently interpreted in Wong Kim Ark as conferring citizenship at birth to virtually everyone born in the US — had effectively elevated citizenship to the status of a constitutionally protected right. Hence, Congress had no right to pass a law which had the effect of depriving an American of his citizenship without his assent.

I know that the death penalty will and treason does but other than that it says the individual must declare he is giving up his citizenship. Reason for wanting to know is the Dems are supposedly reinstating some 200,000 ex-convicts the right to vote so they can have a big up take in certain places.

        • Bob, all good questions. My perspective is that historically, felons have lost a lot of their rights. I see the current trend of giving them ” back” some rights is kind of self-serving. I see it like the “buying” of votes by granting illegal aliens a fast track to citizenship.

          • Hi…I must agree about the buying of votes by any means, According to a group of attorneys I happen to have read about, said some of their cases are about states using laws that are in direct violation of the U.S. Constitution. Few Judges will allow the Constitution in their Court rooms; they say their court is not a Constitutional court. Wonder what type of court that leaves? Further, with each case presented, it seems the Supreme Court makes a decision based upon what the nation currently wants as opposed to actual previously written law. They even go so far as to having multiple definitions for common words and even the use of a word’s tense will change their perception of the law.

            For me the first and most important part of the law (concerning rights removal) is citizenship. Throughout the Constitution the words “the rights of a citizen shall not…” are used a lot. So the first step in removing any rights would be first to remove the citizenship status. One last thing in this post, I think that they are using the term “reinstate” with voting rights is getting the public to assume they could take the right. Additionally it gives them some assumed right to also remove gun possession which in most cases is a violation of title 26 which is an IRS code. It was never codified into positive law and therefore can legally be rebutted. This assumes finding an attorney to even take the case. All attorneys’ first allegiance is to the court and the client second. If you need one ask him/her that question.             The Treaty Clause [2] empowers the President to make or enter into treaties with the “advice and consent” of two-thirds of the Senate. In contrast, normal legislation becomes law after approval by simple majorities in both the Senate and the House of Representatives.

            The Supremacy Clause of the United States Constitution (Article VI, Clause 2) establishes that the Constitution, federal laws made pursuant to it, and treaties made under its authority, constitute the supreme law of the land.

            A constitutional provision announcing the supremacy of federal law, the Supremacy Clause assumes the underlying priority of federal authority, at least when that authority is expressed in the Constitution itself.[4] No matter what the federal government or the states might wish to do, they have to stay within the boundaries of the Constitution. This makes the Supremacy Clause the cornerstone of the whole American political structure.

            In Missouri v. Holland, the Supreme Court ruled that the power to make treaties under the U.S. Constitution is a power separate from the other enumerated powers of the federal government, and hence the federal government can use treaties to legislate in areas which would otherwise fall within the exclusive authority of the states.

            This would allow the UN to regulate the 2nd Amendment and the federal government must implement the law. Congress does have the power to get out of the UN but it would take time and more than a simple majority. Can you imagine our Congress wanting us to retain our gun rights?

            The ruling by the SCOTUS is disturbing and it means the Charter of the UN is the supreme law of the land. Also getting out of the treaty is not easy.

Abbott wants to make, a con-con would also open us up to many other changes in the Constitution that we would not want. There is no guarantee that we could only pass those that Gov. Abbott suggested and not be forced to pass many otheres we do not want, especially with today’s administration and our weak kneed Congress and Senators who continuously fail to do their jobs. We can’t afford to take that chance now!

  4. A Constitutional Convention in this state of affairs would be a dangerous. Hillary already has a new constitution written. The last convention, the old one was completely thrown out and a new one written. If you need to change the Constitution, just amend it, don’t call a convention. Once the convention is started, there are no rules and anything goes.

  5. I do agree that the system has gotten out of control, and Obama has overstepped his boundaries by using the Executive Order on issues such as immigration. Texas is on the border with Mexico, so they have to deal with illegal immigration head on, and it is very unfair for them to be in a position where they are having decisions made hundreds of miles away in Washington, D.C. which only undermines states like Texas from protecting their borders. Sounds like the Republicans are finally waking up and trying to set some limits with the Obama Administration.

          We can have immigration, or we can have a welfare state, but not both, since there’s no way to know who is coming here to work hard and contribute towards making a better life for themselves, and who is coming for a free ride, and to live off of a continuously diminishing tax payer base until the inevitable death spiral and collapse.

Before the welfare state came about, Italian, Irish, German, Chinese (ect) immigrants fostered their own little enclaves where they felt comfortable, but had to learn English and immerse themselves within American culture and the work force as a matter of course, and in so doing they developed an understanding of the values of a free society, and attained some level of assimilation for themselves, and especially their children, and all generations to follow were as Americanized as any other, all while continuing to appreciate their ancestral heritage, as they should.

          • I found this a while back and it is so true. I did not write this, but who ever did I take my hat off to you.

            I bought a bird feeder. I hung it on my back porch and filled it with birdseed. What a beauty of a bird feeder it was, as I filled it lovingly with seed. Within a week we had hundreds of birds taking advantage of the continuous flow of free and easily accessible food.

            But then the birds started building nests in the boards of the patio, above the table, and next to the barbecue. Then came the poop! It was everywhere, on the patio tile, the chairs, the table…everywhere!

            Then some of the birds turned mean. They would dive bomb me and try to peck me even though I had fed them out of my own pocket. The other birds were boisterous and loud. They sat on the feeder and squawked and screamed at all hours of the day and night and demanded that I fill it when it got low on food.

            After a while, I couldn’t even sit on my own back porch anymore. So I took down the bird feeder and in three days the birds were gone. I cleaned up their mess and took down the many nests they had built all over the patio.

            Soon, the back yard was like it used to be…quiet, serene and no one demanding their rights to a free meal.

            Now let’s see…..

            Our government gives out free food, subsidized housing, free medical care, and free education and allows anyone born here to be an automatic citizen.

            So the illegals come by thousands. Our taxes continue to go up and up and up to pay for the abuse of tax-funded services; apartments are housing 5 families; you have to wait 6 hours to be seen by an emergency room doctor; your child’s 2nd grade class is behind other schools because half the class doesn’t speak English and refuses to learn. Corn Flakes now come in a bilingual box; you have to ‘press one’ to hear your own bank talk to you in English, and people who wave flags other than ‘Old Glory’ are squawking and screaming in the streets, demanding more rights and free liberties. When asked why they breed like cockroaches, the reply is that it is a cultural thing.

            Just my opinion but, maybe its time to take down the bird feeder.

They are encouraged to keep their own language, they are not being taught traditional American values, they are not being given an education of what “opportunity ” means, and are being cultivated to be dependent on the largesse of a government that they do not see as theirs. And that is from the public educational system. Yes, my parents, uncles, aunts, etc. , were mainstreamed quickly, at the insistence of my grandfather. He was an imposing individual. My grandmother I remember as always speaking German. She did not learn English at all. I remember her with a very old-fashioned hairdo, and always wearing black dresses, and sitting in the kitchen. The kids spoke German AND English. My mother would sometimes mix German and English together, which really confused me. I truly believe that they were taught American patriotism at their father’s knee, and internalized it.

          • I agree, it is being shortstopped as much of the impetus to assimilate has been removed. Why learn English if gov’t service providers caters to one in their own language as is done with native Spanish speakers for everything from licensing to drive, applying for assistance, to registering to vote.

            Before all this came about, it was routine for immigrants to hang on to their culture and language, mostly for one or two generations or so, before those who remembered the old country had passed on. But now, immigrants having lived on welfare, in many cases, for multiple generations, has reinvented the paradigm and led to many negative outcomes, both for society as a whole, as well as for immigrants themselves at an individual level. It has devolved into a not so secret vote purchasing scheme by the establishment.

          • I don’t really have anything against immigration, it’s just that we can’t have an open door immigration policy and an open door welfare state. There’s just no way to vet who’s coming for the opportunity and who’s coming for a free ride and/or to send remittances back home at American tax payer expense and fasttracking citizenship is an insult to those immigrants that came in legitimately and did what was expected of them to earn it . I would say the whole thing is ridiculous, but we’re long past that now, and it’s such a woefully inadequate understatement.

          • Oh I believe that just about everyone is fine with a safety net, the problem are those that are just living in it, as well as all the moral hazard that the current welfare state breeds, its effects on the family, and the once proud American work ethic that is no longer passed from parent to child. Of course gov’t overregulation has taken a significant toll upon the economy and the job market remains soft, and the inflation of the money supply has reduced the purchasing power of the dollar, and the ACA has converted many full time jobs into part time, meaning there are many people out there who do need assistance, but there’s no way to tell them apart from the free loaders, and of course the “answer” to all this is more and more gov’t regulation.

            As to the EU, have they learned anything? Are the governments there reversing the policies, or are they just doing pretty much the same thing as here, denying that there’s a problem, and telling women to dress conservatively and “hold muslim males at arms length”, it’s crazy sh-t. All of this BS is designed to purchase votes to keep politicians in power, and they don’t care about the long term consequences of their policies, because they plan to be long dead of natural causes before that, same as in this nation, and the problem will be someone else’s. It’s this “bring on the champagne, while the Titanic sinks beneath us” blasé musical chairs attitude that politicians have, and that’s why I hold out little anticipation of it ever being corrected.

          • Several states ( Maine comes to mind, the others I disremember) made a rule that to get welfare, you have to contribute 20 hours of work to the community, unless you are frail elderly. physically unable to work, etc. The state welfare rolls fell from about 40,000 to about 12,000 precipitously. Too many times, we are presented with something that appears to be an answer, but it is a wolf in sheep’s clothing. Anything that is discussed, needs to have full transparency and disclosed to the states… and, if in any way, it even has a faint whiff of giving any power tot he Executive or the Judicial branches… needs to be disclosed to each state’s gubernatorial and state legislative branches… and the full proceedings need to be disclosed to the public on a day to day basis… via ALL forms of media… newspapers, all networks, FOX News and the websites on the internet.

The issue needzto be addressed before proceeding with a 2/3 vote to overturn their decisions. The issue of Executive Orders NOT being laws, isxalso needed to be addressed! Our Constitution States, only Congress is permitted to write a pass laws! The President is not permitted to write laws, pass laws or attempt to do so by Executive Order!

      I find it very disagreeable that the charges used were basically non-starters. The result was he could write off all the bad stuff (special investigator cleared) and he knew he would not lose the position after everything was done. The public was modified, he would not face investigation again, and although in theory he was convicted but nothing happened.

      The fact that he was not removed from office does not change any facts that led to his being charged with an impeachable offense. Even less would be done to Obama and now they say it is too late he will be leaving soon. Maybe! What would happen if Clinton has Obama as the vice president and then she gets sick and resigns?

You only need to do three things to be ripe for takeover. 1. Get most of the people dependent on the government for their basic needs (we are there). 2. Make the money used by the country virtually worthless (we have printed so much we are there). 3. You must disarm the population. We are not there yet but getting closer than many think. There are many laws which are not generally known that inhibit having guns. For example; constructive possession of a weapon: If anyone in the home has a felony nobody in the home may have a weapon (you may own them if kept is a secure locked container of their choosing) because otherwise the felon may constructively possess the weapon. Now the Constitution does not give the courts the ability to remove a Constitutional right (Amendment 2) and I have not seen any sentence report that says you lose the right to vote or possess weapons but, you for sure must keep the right to pay taxes. Anyway, the best defense against any political takeover is to arm your-self with more knowledge than is currently taught in our school system or provided by any news media. Then take that knowledge to the ballot box to see if that right is still available or will a candidate remove it if elected?

  34. Here is some information about the Governor trying to set the stage for Constitutional changes.Remember this…if they do convein for a good reason that would not prevent them from changing anything else that they want to change including any enumerated right the people may have.

    Article IV

    Section 1. Full faith and credit shall be given in each state to the public acts, records, and judicial proceedings of every other state. And the Congress may by general laws prescribe the manner in which such acts, records, and proceedings shall be proved, and the effect thereof.

    Section 2. The citizens of each state shall be entitled to all privileges and immunities of citizens in the several states.

    Article V

    The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; provided that no amendment which may be made prior to the year one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate.

    Title [18 USC 241] states in part “…If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured – They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

    I find it profoundly offensive that any of you believe that everyone who is against amnesty (or a “pathway for legalization” as it was so eloquently put) or your other policy changes is a demagogue (i.e., a racist, a bigot, or someone who will play on the fears of others in order to further their own agenda). Do you really believe that the majority of Americans are demagogues simply because they oppose your programs and amnesty?

    I oppose amnesty not because I dislike illegal aliens but because these individuals have broken the laws of this country (laws you swore to uphold) by illegally coming to the United States and they should not receive a get-out-of-jail-free card simply because they are here. The laws pertaining to illegal alien entry also reads that anyone who helps an illegal to continue to break the law (by remaining here) is guilty of a conspiracy and are they themselves committing a felony. The law further does not exclude local governments, (no safe cities) persons, or other named entities from prosecution for these felony conspiracy crimes which include aiding and abetting criminal activity, In addition it further does not exempt law enforcement officers. To grant amnesty to these individuals would reward their illegal activity, the illegal activity of those who helped them to remain and encourage more people to follow. There are numerous federal felonies being committed under a quasi legal umbrella of support offered by the federal government. I encourage you to have an open mind and listen to opponents of amnesty. We are not “demagogues,” but are hardworking Americans who believe in the rule of law. You should be ashamed of the comments made in Guadalajara and other places as they are an embarrassment both to yourself and to the Office of the President. I spent most of my adult life in defense of my country and became a disabled veteran in the process, and being called names because I still want to protect my country is a double disgrace one to me and the other to you. The federal government acts and speaks like it has a separate source of money to use at their disposal (they don’t) and then they say they are doing these great things for the American people. You cannot give anything to anyone without first taking it from someone else. As I see it, the only people who subscribe to these current giveaway programs are those who will profit sooner or later, those who will obtain it for free (including illegal aliens) and those who want to control it for their personal agenda.   39. I absolutely disagree that a Convention of the States would fix more things than the trouble it might cause.

    Too many (even “conservative”) legislatures are enamored with the power of government. For every leftie that wants to take over school curriculum or create a “free” kindercare program, there’s a “conservative” who insist’s it’s government’s role to keep gay people from enjoying the same privileges and immunities as straight people or to punish people who use recreational drugs.

    Letting the camel’s nose under the tent is not the magic bullet. The slow, methodical, and occasionally painful electoral process is.
